Please read these Terms and Conditions (‘Terms’) carefully before using the Spirit of Mum mobile application (‘the App’). These Terms constitute a legally binding agreement between you (‘you’ or ‘User’) and Spirit of Mum (‘we’, ‘us’, or ‘our’).

By downloading, registering for, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

1. About the App

Spirit of Mum is a community platform designed to connect mothers across Australia. The App provides features including user profiles, personalised matching, in-app messaging (chat bubbles), community posts, and parenting resources.

The App allows you to post content including text, photos, profile information, and messages (‘User Content’). By submitting User Content, you:

You understand that in-app messages you send are visible to the recipient(s) and may be reviewed by us if a safety or conduct concern is reported.

7. Intellectual Property

All content, software, designs, trademarks, logos, and materials forming part of the App (excluding User Content) are owned by or licensed to Spirit of Mum and are protected by Australian and international intellectual property laws.

You must not reproduce, distribute, modify, reverse-engineer, or create derivative works from any part of the App without our prior written consent.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and disclose your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the App, you consent to our data practices as described in the Privacy Policy.

Our Privacy Policy is incorporated into and forms part of these Terms.

9. Third-Party Services

The App may integrate with or link to third-party services, including Apple Sign In, Google Sign In, cloud service providers, and external websites. Your use of third-party services is governed by their own terms and privacy policies. We are not responsible for the content, practices, or reliability of any third-party service.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided on an ‘as is’ and ‘as available’ basis, without warranties of any kind, either express or implied. We do not warrant that:

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) which cannot lawfully be excluded or limited.

To the extent the App constitutes a service to which statutory consumer guarantees apply, our liability for failure to comply with a guarantee is limited (at our election) to:

We reserve the right to suspend or terminate your access to the App at any time, without notice and at our sole discretion, where we reasonably believe you have breached these Terms or pose a risk to the safety of our community.

You may close your account at any time via the App settings or by contacting us at privacy@spiritofmum.com.au. Upon termination:

We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification or email before the changes take effect. Your continued use of the App after updated Terms have been notified and posted constitutes acceptance of the revised Terms.

If you do not agree to updated Terms, you should stop using the App and close your account.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia for any dispute arising under or in connection with these Terms.

17. Dispute Resolution

We encourage you to contact us in the first instance to resolve any dispute informally. Please email us at privacy@spiritofmum.com.au with details of your concern and we will endeavour to respond within 10 business days.

If we are unable to resolve the dispute informally within 30 days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) or another agreed mediator before commencing court proceedings.

18. General

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spirit of Mum in relation to your use of the App.
